Slave Labor in Tomatoland

If you live in the United States and you eat fresh tomatoes in the wintertime, you’ve almost certainly tasted a tomato that was picked by a slave.

“That’s not an assumption. That’s a fact,” reveals U.S. District Attorney Douglas Molloy to former Gourmet magazine contributing editor Barry Estabrook in Estabrook’s book, Tomatoland. Molloy is a veteran government prosecutor with more than a decade of experience dealing with crime in Immokalee, Florida, a town at the center of Florida’s tomato industry. And he calls Immokalee “ground zero for modern day slavery.”

Roughly 90 percent of the slicing tomatoes sold in the winter in the United States come from industrial farms in the Sunshine State. To ensure they survive the long journey from balmy Florida to places as far away as Detroit or Seattle with nary a dent, the perfectly round, perfectly red winter tomatoes that line supermarket shelves and feed fast food restaurant customers in northern states in December are actually picked while green and hard. Later, these unripe tomatoes are gassed en masse in warehouses with ethylene — the same gas tomato plants produce naturally when their fruits are ripening — to turn them prematurely red. (If you’ve ever wondered why supermarket tomatoes in winter taste vaguely like tomato-colored wood pulp, this common industry practice would be a big reason why.)

Spain's salad growers are modern-day slaves, say charities

Charities working with illegal workers during this year's harvest claim the abuses meet the UN's official definition of modern-day slavery, with some workers having their pay withheld for complaining. Conditions appear to have deteriorated further as the collapse of the Spanish property boom has driven thousands of migrants from construction to horticulture to look for work.

The Guardian's findings include:

• Migrant workers from Africa living in shacks made of old boxes and plastic sheeting, without sanitation or access to drinking water.

• Wages that are routinely less than half the legal minimum wage.

• Workers without papers being told they will be reported to the police if they complain.

• Allegations of segregation enforced by police harassment when African workers stray outside the hothouse areas into tourist areas.

Labor Trafficking News from November

Throughout the month, there are many cases or stories that break regarding forced labor. They are usually not on the front pages of our newspapers, rather they are buried deep and sometimes are only accessible through the internet. These are some of the stories, both headline articles and those that are not, from November.

Markus Löning, Germany's Human Rights Commissioner, criticized Uzbekistan for its use of child labor in the yearly cotton harvest. He demanded that the country allow monitors to enter the country and that it stop using children during the harvest. Each year, in September, schools are closed and students as young as seven are forced to pick cotton in the fields. The country has signed two Conventions against child labor and Löning asked them to honor their commitments. At least 65 retailers including Gap and Wal-mart, boycott Uzbek cotton.


Debates raged throughout November about whether or not carpets made in India would lose designation as being produced through child and or forced labor by the United States Government. The Deputy Undersecretary of Labor, Sandra Polaski, said that the US had not determined the status of the carpets, while India's Carpet Export Council claimed that the US would drop the designation. The Department of Labor clarified that it had not removed India's carpet industry from the list, but rather believed there was not enough suitable information to determine whether it should be kept on the list. They are awaiting the results of a study on child and forced labor in Asia to determine if India should remain on the list.


The Irish Human Rights Commission asked Ireland's Government to launch an investigation of the Magdalene laundries or asylums, where women of ill-repute were forced to undertake forms of hard labor including laundry work, even into the 20th century. The Commission said that appropriate redress should be provided to the survivors of the institutions. The findings included evidence that the State knew and was involved in the process of sending women and girls to the laundries. It is also possible that the Government violated obligations it undertook through the 1930 Forced Labor Convention by not outlawing or stopping the laundries and by trading with the convents that were running the laundries. The Government admitted as early as 2001 that the women were victims of abuse but no redress has been provided.


No agreement was reached on the future of Zimbabwe diamonds after a four day meeting of the Kimberly Process. While the Chairman, Boaz Hirsch, said he was hopeful that an agreement could be reached within a few days after the meeting, as of the end of November there still was no deal. Obert Mpofu, Zimbabwe Mine's Minister, said that despite the lack of an agreement, diamonds would still be for sale with no conditions to those who wished to purchase them. Sales of Zimbabwe's diamonds were barred last year due to human rights abuses, including the use of forced labor, in the Chiadzwa fields.


Three illegal immigrants were indicted by a federal grand jury in connection with a human trafficking scheme which forced its victims to sell CD's and DVD's. Charges included conspiracy to harbor illegal immigrants and conspiracy to force labor. Victims were recruited from Mexico and forced to sell the pirated wares. The accused are believed to have intimidated victims into working until they paid off their debts.


After Cyclone Giri, which hit Myanmar at the end of October, the Government began forcing affected villagers to assist with renovations including helping rebuild military sites without pay. This was one of the hardest affected areas by the cyclone. The villagers are staying in makeshift huts, since many people have not been able at this point to rebuild their own homes and since they are forced to work from dawn to dusk on Government/Military projects.

Thoughts for Thanksgiving: 50 Years Since Harvest of Shame



The day after Thanksgiving in 1960, the documentary Harvest of Shame, a report by Edward Murrow about the situation facing agricultural workers, was aired. 50 years later, agricultural workers in the U.S. still struggle with many of the problems exposed by this film: poverty wages, sub-standard housing, untreated injuries, children being kept out of school, lack of labor regulations and/or enforcement, long, sometimes dangerous journeys to find work, among many others. I kept thinking as I watched the documentary, how many of the quotes in this film could we simply transpire to a modern documentary on agricultural labor?

"We used to own our slaves, now we just rent them."

"But a migrant was just a person who worked on a farm to me."

The response of the employer, who claimed that farmworkers are the happiest race of people in the world. "They just love this."

"They have no voice in the legislative halls. They certainly have no voice in Congress. And their employers do have a voice. Their employers are highly organized, and make their wants and terms and conditions known to our legislators."

We still cling to a romantic view of farm life - the one of commercials of glistening fruit and fields waving back and forth with the wind. The happy farmer- gloved and smeared with dirt. While there is much pride in the act of growing food and nourishing people, the reality is that the problems exposed in this film today are compounded by the industrial agricultural system that has exploded since 1960.

Farms are larger and must answer to the demands of consumers of supermarkets and fast food chains and the system relies on cheap labor. People are no longer connected to the food they eat. Think about the Thanksgiving meal you enjoyed today - do you know the origin of your ingredients or under what conditions the food was brought to your table? It is very likely migrant or immigrant farm labor helped make that Thanksgiving meal happen.

Harvest of Shame is, unfortunately, not far from today's reality in the fields. The demographics of farmworkers might be different, but slavery, abuse and poverty are still common. And just as there are many relevant quotes to be pulled from Harvest of Shame, there are also relevant questions that we should still be asking ourselves:

"Is it possible that we think too much in terms of charity, in terms of Thanksgiving Day baskets, in terms of Christmas baskets, and not in terms enough of eliminating poverty?"

"Must the 2 to 3 million migrants who help feed their fellow Americans work, travel and live under conditions that wrong the dignity of man?"

Historic Breakthrough in Florida's Tomato Fields

Last week, the Coalition of Immokalee Workers announced that they and "the Florida Tomato Growers Exchange (FTGE) have reached an agreement that will extend the CIW's Fair Food principles – including a strict code of conduct, a cooperative complaint resolution system, a participatory health and safety program, and a worker-to-worker education process – to over 90% of the Florida tomato industry."

In a CIW Press release, Lucas Benitze said “This is a watershed moment in the history of Florida agriculture. With this agreement, the Florida tomato industry – workers and growers alike – is coming together in partnership to turn the page on the conflict and stagnation of the past and instead forge a new and stronger industry.”

An article in the Atlantic points out "One penny a pound might not seem like a very big raise, but when you pick a ton of tomatoes a day, as a Florida farm worker can, one penny represents a raise from $50 to $70, the difference between poverty and a livable (though still paltry) wage. And it doesn't seem radical to suggest that growers should abide by a reasonable code of conduct that includes a mechanism to address complaints, a health and safety program, and training sessions."

According to the CIW website, "The CIW is a community-based organization of mainly Latino, Mayan Indian and Haitian immigrants working in low-wage jobs throughout the state of Florida." The CIW began campaiging for workers' rights in 1993, taking on fast food giants like Taco Bell, McDonalds, and Burger King along the way. They also have an Anti-Slavery Campaign, which they describe as "a worker-based approach to eliminating modern-day slavery in the agricultural industry. The CIW helps fight this crime by uncovering, investigating, and assisting in the federal prosecution of slavery rings preying on hundreds of farmworkers."

Of last week's victory, Benitze said: “Make no mistake, there is still much to be done. This is the beginning, not the end, of a very long journey. But with this agreement, the pieces are now in place for us to get to work on making the Florida tomato industry a model of social accountability for the 21st century.”

Can The Buying Local Movement Help Prevent Trafficking?

At a recent talk at Harvard Kennedy School, John Mackey, Co-CEO of Whole Foods stated that the demand for locally sourced food is exploding. Authors like Michael Pollan and sites like Sustainable Table and Local Harvest, among many others promote the practice of buying organic food from local sources as a way to create a more sustainable food system than the one dominated by fast food restaurants and supermarkets. The environmental benefits to buying local organic food are clear: Buying local reduces the use of fossil fuels needed to bring the food to your plate. According to Food Routes, food travels on average 1,300 miles from farm to table; Buying organic reduces reliance on harmful chemical pesticides and other synthetic agricultural inputs.

Economically, buying local either by demanding it in your local stores, joining a CSA or shopping at local farmers markets often helps sustain smaller farms in your area, which have largely disappeared as a result of the rise of industrial agriculture. This also contributes to many health benefits by avoiding industrial animal production and consuming more fruits and vegetables. So what is the connection to trafficking?

My concern is that a sustainable food system should be about even more than the environmental, health and local economic factors that currently dominate the drive for locally sourced food. All of those factors deserve honest attention, and I personally believe the benefits of buying more local organic foods are sizable.

However, the current rationale behind buying local is not enough.
Agricultural cases are a growing percentage of trafficking cases nationwide, and the State Department has listed agriculture as one of the primary industries in which trafficking occurs in the U.S. While many of these often cases involve large or industrial farms, it still affects local food sourcing.

Let's take the Aloun Farms case:
Aloun Farms provides produce for local groceries, farmers markets and is intricately connected to the local community through events and food drives. According to an article in the Examiner, "Eliminating their products could potentially mean that local consumers will have no choice but purchase produce that is shipped here..." Yet the farm's owners, Alec and Mike Sou plead guilty to trafficking charges earlier this year and are now facing additional charges connected to the case.

Despite the illustration provided by this case, there is no conflict between the buy local movement and the anti-trafficking movement. In fact, hopefully, the buy local movement can serve as a check on labor practices in agricultural industry and the two movements can complement each other. If people are more aware of the source of their food, hopefully more attention will also be paid to the labor that helps bring that local food to their table because the risk of trafficking is local as well.


It was actually John Mackey's talk that inspired this post: if the demand for locally sourced food is exploding as he says it is, then I am sure more grocery chains and supermarkets will pick up on the trend. While this has many potential benefits, we also run the risk of becoming content with supermarkets telling us that the food is sourced locally and ending our concerns there. The increasing demand for locally sourced food should not be satisfied by the mere knowledge that the food is from a local farm: What are the labor practices of that farm? What are the environmental practices of that farm?

I am not accusing people fighting for a more sustainable food system of ignoring the labor concerns of agricultural workers. On the contrary, there is a lot of potential for the movement for more sustainable food systems to act as a preventive agent against slavery. As demand for local food grows, hopefully the stronger connection between consumers and farms will help lead to fewer victims in the agricultural sector.

Slave Trader Joe's?

Is Trader Joe's Selling Slave Picked Produce?

Trader Joe's presents itself as a hip, progressive place to shop, full of vegetarian options and free from the plethora of hot orange processed snacks found elsewhere. But Trader Joe's refuses to take one very critical progressive step and join the Coalition of Immokalee Workers' (CIW) Campaign for Fair Food. And because of their refusal, you might just be buying slave-picked produce from those friendly, Hawaiian shirt-wearing joes.

Modern-day slavery is a reality for many farm workers right here in the U.S. In Florida, over 1,000 people have been identified as trafficked in fields and on farms, picking the food we eat every day. Farm workers have also been trapped in slavery or seriously abusive conditions in California, Washington, North Carolina, Maryland, and several other states with large agricultural industries. Because the laws governing agriculture are different than those regulating other industries in the U.S., many of these workers don't have the same legal protections the rest of us do.

Trader Joe's is no stranger to dealing with labor and transparency concerns. Two years ago, a 17-year-old girl suffered a fatal heat stroke while picking grapes for Charles Shaw wine, the "Two Buck Chuck" Trader Joe's is famous for. And folks over Change.org's Sustainable Food property are asking the company for better transparency in their organic food sourcing. TJ's has also gotten flack for selling un-sustainable seafood and fish from places like Thailand and Bangladesh, where slavery in the fishing industry is common. That's a pretty poor track record for a company with a progressive, conscious customer base.

This is where you, that conscious customer, come in. As a consumer, you have the power to ensure the workers who grow and harvest your food are getting fair pay for their work and are being treated with dignity. The CIW's Campaign for Fair Food harnesses the purchasing power of the food industry for the betterment of farm worker wages and working conditions. Over the past decade, CIW has used the campaign to get some of the largest food purchasers in the country to support fairer labor standards for farm workers in the U.S., including a zero tolerance policy for slavery and transparent supply chains. Current participants include Subway, McDonald's, and Whole Foods. Now, Trader Joe's has the opportunity to join them and take a stand against slavery and farm worker exploitation.

Please, take a minute to ask Trader Joe's to join the Campaign for Fair Food and ensure that they aren't selling their customers slave-picked produce.

Trader Joe's has a wide reputation for being a company where people can purchase food and feel good about it. Unfortunately the secrecy of the organization, their unwillingness to join the Coalition of Immokalee Workers' (CIW) Campaign for Fair Food and some of their practices put this feeling into question. One of these practices includes sourcing unsustainable seafood from Thailand and Bangladesh where slave labor in the seafood industry is unfortunately not uncommon. Additionally, the death of a 17 year old who was picking grapes for Trader Joe's wine has also created concern among activist. H2-A Abuse: Largest Human Trafficking Case in the US

The Justice Department announced Thursday that a federal grand jury in Honolulu indicted Mordechai Orian, an Israeli national; Pranee Tubchumpol, Shane Germann and Sam Wongsesanit of Global Horizons Manpower Inc., located in Los Angeles; and Thai labor recruiters Ratawan Chunharutai and Podjanee Sinchai for engaging in a conspiracy to commit forced labor and document servitude.

The charges arise from the defendants’ alleged scheme to coerce the labor and services of approximately 400 Thai nationals brought by the defendants to the U. S. from Thailand from May 2004 through September 2005 to work on farms across the country under the U.S. federal agricultural guest worker program, according to the justice department.

Orian, Tubchumpol and Chunharutai are also charged with three substantive counts of compelling the labor of three Thai guest workers.

If convicted, Orian and Tubchumpol each face maximum sentences of 70 years in prison, Chunharutai faces a maximum sentence of 65 years in prison, Germann and Wongsesanit each face a maximum sentence of 10 years in prison, and Sinchai, who was recently charged in Thailand with multiple counts of recruitment fraud, faces a maximum sentence of five years in prison if convicted in the United States.

The indictment alleges that the defendants conspired and devised a scheme to obtain the labor of approximately 400 Thai nationals by enticing them to come to the U.S. with false promises of lucrative jobs, and then maintaining their labor at farms in Washington and Hawaii through threats of serious economic harm. 

The defendants arranged for the Thai workers to pay high recruitment fees, which were financed by debts secured with the workers’ family property and homes. Significant portions of these fees went to the defendants themselves. 

After arrival in the United States, the defendants confiscated the Thai nationals’ passports and failed to honor the employment contracts. The defendants maintained the Thai nationals’ labor by threatening to send them back to Thailand, knowing they would face serious economic harms created by the debts. 

The indictment also alleges that the defendants confined a group of Thai guest workers at Maui Pineapple Farm and demanded an additional fee of US$3,750 to keep their jobs with Global Horizons. Those workers who refused to pay the additional fee were sent back home to Thailand with unpaid debts, subjecting them to the high risk of losing their family homes and land.

This case has been investigated by the FBI’s Honolulu Division. Services to victims have been provided by the Thai Community Development Center in Los Angeles. The charges, in a five-count indictment, are merely accusations, and the defendants are presumed innocent unless and until proven guilty.

This is the largest human trafficking case to come out of the United States and involves nearly 400 Thai workers who were recruited under false pretenses to work in the United States on H2-A (agricultural worker) visas. The defendants are six employees of Global Horizons Manpower Inc. including two Thai recruiters. Though the charges for each person vary, two of the defendants are facing up to 70 years in prison.

This particular article helps illuminate the specific forms of force fraud or coercion used against the workers. For example, many of the workers had to take out significant debts, sometimes against their families’ homes and properties. When they arrived in the US, the working conditions were not as promised and the workers were paid less than they expected. In one case, the workers were confined on a pineapple farm and told they would have to pay $3,750 to keep working with the company. Those who refused were sent back to Thailand where they faced significant risks including losing their houses for not paying off their debts.

This will likely be a very interesting case to follow and more details are expected to emerge in the coming weeks and months. The trail is set to begin in November.

Nonprofit Aloun Foundation Got $2 Million Fed Loan

The owners Kapolei's Aloun Farms -- who've already pleaded guilty to human trafficking some of their farm workers -- received a multimillion dollar federal loan to buy an apartment in which to house their farm employees.

Brothers Mike and Alec Sou have already pleaded guilty to conspiracy to commit human trafficking for mistreating workers brought in from Thailand to work on one of Oahu's largest fruit and vegetable operations, Aloun Farms. They await sentencing in September.

Now, KITV4 News has learned a nonprofit corporation set up by the Sou brothers, the Aloun Foundation, received $2.1 million in low-interest loans from the U.S. Agriculture Department to buy a four-story Wahiawa apartment complex to house low-income farm workers.


The mortgage for 104 Lakeview Circle shows the loan deal was signed in July 2008, just before the FBI began its federal human trafficking investigation.


Tax returns filed by the nonprofit Aloun Foundation list Alec Sou as president, and his brother Mike and their mother and father as directors. The nonprofit “supports cultural and historic agricultural activities in Hawaii through providing low cost living assistance to employees working in those organizations,” according to its 2008 tax return.


"It's a real straight up deal, and it really is serving a public purpose," said Craig Watase of Mark Development, property manager for the apartment house.

All of the rental units house at least one resident who works at Aloun Farms, he said. Residents at the complex confirmed that to a reporter Monday and said most of them were Micronesian, with two families from Hawaii.

Watase said the residents here must meet federal low-income levels to qualify for subsidized rentals, paying 30 percent of their income in rent and the U.S. Department of Agriculture picking up the rest. “It’s a good thing, and it’s on the up and up. It’s federally audited and monitored,” he said.


The Sous pursued the federal loan through their nonprofit instead of their for-profit farm because non-profits have a "better chance" of winning help from the federal government, Watase said.


He said in the nearly two years he has managed the property, only employees from Aloun Farms have been tenants there, but they’ve “tried to reach out to employees of other farms.”

"I think it's interesting and a little troubling how the Sou brothers know how to work the system," said Clare Hanusz, the attorney representing 27 former Aloun Farm workers who are trafficking victims in the federal criminal case and did not live at the Wahiawa apartment complex.


"Why this would fall under the guise of a nonprofit foundation as opposed to their for-profit enterprise is potentially concerning," she said. "I don't know hy Aloun Farms wouldn't just pay a living wage so that its workers wouldn't have to use subsidized, basically federal government subsidized housing."

Sources told KITV4 News the state attorney general's office is investigating to determine whether the Sous are using the apartment owned by their nonprofit organization as an extension of their for-profit farm.


We've
covered parts of this story out of Hawaii, that actually operated all over the US, in the past. The sentencing in this trial started in June, however is set to continue in September after an agreement could not be reached. I find this particular finding interesting because I think it highlights that although traffickers make efforts to prevent their abusive practices from being discovered and punished, they can also operate in general quite publicly. Traffickers can be active community members, producing goods for major grocery chains, or, in this case, federal grantees. We can never assume that just because an agricultural employer is providing goods or services to major companies or works with grant monitors of the federal government, they are not capable of being traffickers.

First US Recipient of State Department's Anti-Trafficking Hero Award to Be Given This Year




Great news out of Washington, DC: U.S. State Department to recognize CIW Anti-Slavery Coordinator Laura Germino as 2010 "Anti-Trafficking Hero"!

As part of the annual TIP report release, the State Department recognizes the efforts of a handful of individuals from around the world who have shown extraordinary commitment and leadership in the fight against slavery, TIP "Heroes" as the State Department calls them.

This year, Laura Germino, the CIW's Anti-Slavery Campaign Coordinator, has been chosen to receive this terrific distinction, and when she does, she will be the first U.S.-based recipient to receive the recognition.

We are extremely proud of Laura, whose untiring work fighting forced labor in Florida -- beginning in the early 1990's -- helped launch today's anti-slavery movement in the U.S. Nearly twenty years later, Laura continues to investigate slavery operations, work in partnership with the Department of Justice to prosecute slavers, and train state and local law enforcement, community service organizations, and FBI personnel in how to identify and combat forced labor across the Southeast.

We are also very proud that the State Department has requested that the CIW's Modern-Day Slavery Museum serve as the backdrop for the 2010 TIP report ceremony. The museum will begin its way up 95 tomorrow with the goal of making it there in one piece for Monday's ceremony in Washington, DC!

The museum, housed in an actual cargo truck outfitted as a replica of the trucks involved in a recent slavery operation (U.S. v. Navarrete, 2008), may or may not make it there for the ceremony, so, just in case it doesn't, we're including here a great video on the museum and its tour earlier this year across the state of Florida. The video is set to, "Captain, Don't You Kill Old Bob," a work song performed by Fred Lee Fox, a 20-year-old turpentine worker, in 1939. The song was recorded by Stetson Kennedy, Florida's foremost folklorist and a renown human rights activist, at a labor camp outside Cross City, Dixie County, Florida.

My personal exposure to the work of this organization leaves me with great happiness that this award is being given to Laura Germino. HRW Releases Report on Child Labor in U.S. Agriculture

Last month, Human Rights Watch released a report called Fields of Peril, a 99-page report that details the risks the child farmworkers face concerning their safety, health, and education on commercial farms across the United States. HRW interviewed 70 children under age 18 who were or are legally employed as farmworkers in 14 states in various regions of the U.S.

As the report details, agriculture is a tricky industry when it comes to child labor. The rules and regulations are different than almost any other industry allowing children as young as 12 years of age to work legally in what are often times very hazardous conditions. In fact, the report cites that from 2005-2008, there were 43 minors who died from work related injuries in crop production. "The risk of fatal injury for agricultural workers ages 15 to 17 is more than 4 times that of other young workers."

In addition to these risks, the report exposes readers to the long-term health consequences often suffered by children working in agriculture who are often exposed to pesticides, suffer from injuries from repetitive motions, work despite injuries, and work despite extreme cold or heat. Crop workers on U.S. farms suffer from heat fatalities at a rate of 20 times higher than any other U.S. civilian workers.

The abuses they suffer do not end there: many must work long hours furthering their health and safety risks and affecting their school performance (if they are able to go to school at all); many children stated their employers do not provide sanitation facilities and drinking water on-site (despite the fact OSHA requires these be provided to farms with more than 10 workers); girls also experience significant sexual harassment and violence.

Although the report focused on the interviews it collected, which were only with minors who were legally employed in the agricultural field, Fields of Peril also interviewed service providers who work with undocumented minor agricultural workers, both unaccompanied and those with their parents. Unaccompanied minors, however, are a growing population according to service providers who work with farmworkers.

Those who are undocumented or whose parents are undocumented live under constant fear of deportation or separation from their families. This fear, according to a service provider interviewed for the report, trumps any desire to report abuses: "Even people who are documented have family members who are undocumented so they are afraid to speak up."

All of these risks create a precarious situation for any minor working in the agricultural industry. It is no coincidence that abuse, fatalities and injuries occur at such a high rate and that even the weak laws that do protect the workers are poorly enforced. Unaccompanied migrant children, in particular, represent a significant risk group for trafficking because the ability to coerce and force these young people is stronger due to a broader set of vulnerabilities. Not to mention the risk of girls being exposed to sexual exploitation. It is interesting that it is still required to show force, fraud and coercion to prove a case of child trafficking for labor as this is not a requirement for cases involving trafficking for sexual exploitation.

The report is definitely worth reading. You will learn more about the kind of labor that often goes into putting food in U.S. grocery stores and restaurants and, eventually, all of our plates. Hopefully, this will inspire many concerned about trafficking in our food system to get involved. The report includes recommendations in the final section. Pay attention in particular to the recommendations to state and federal lawmakers and contact your representatives to put pressure on them to pass these recommendations.
